What this document is

This is the standard power of attorney of Thailand's Department of Lands (กรมที่ดิน) — form T.D. 21 (ท.ด. 21) with the printed subject «ให้ถือกรรมสิทธิ์รวม»: granting joint ownership. The owner of a titled plot (chanote, โฉนดที่ดิน) uses it to have a representative register, at the land office, a share of the plot for another person, who becomes a co-owner.

The form is one page and in Thai only. The text of the authority is already printed: the attorney grants the named person joint ownership of the stated share (for example 1 part of 2), with or without buildings, with or without consideration, and gives statements to the land officer.

Who fills it in and where it is filed

  • the grantor — the landowner who gives the share;
  • the attorney — the person who goes to the land office on the grantor's behalf;
  • the power of attorney is presented at the land office (สำนักงานที่ดิน) where the plot is located when the registration is made;
  • as a general rule foreigners cannot acquire land in Thailand — check the new co-owner's eligibility with the land office.

What the form asks for

  • plot details from the chanote: map sheet (ระวาง), land number, survey page, deed number, sub-district, district, province;
  • place and date (year in the Buddhist Era, พ.ศ.);
  • grantor and attorney: name in Thai script, Thai ID number, age, race (เชื้อชาติ), nationality, parents' names, registered address, phone;
  • the new co-owner and the size of the share — «จำนวน … ส่วน ใน … ส่วน»;
  • with or without consideration, the amount in figures and in words;
  • buildings on the plot if the share includes them: type, storeys, number, house number;
  • handwritten signatures of the grantor and two witnesses.

Documents usually needed

  • the original chanote of the plot;
  • copies of the grantor's and attorney's ID cards and house registrations, signed as true copies;
  • the new co-owner's documents for the registration.

The form does not state the full list of documents, fees, taxes or processing times — check them with the land office. The form refers to a warning on the back; the official file has no reverse page.

What is this power of attorney for?

It lets another person register, at the land office, a share of your plot for a new co-owner: sign the documents and give statements to the officer on your behalf.

How is it different from the «ขอถือกรรมสิทธิ์รวม» power of attorney?

This one («ให้ถือกรรมสิทธิ์รวม») is given by the owner who grants the share. The Department of Lands has a separate form «ขอถือกรรมสิทธิ์รวม» for the party asking to be added as co-owner.

How is the size of the share stated?

The form prints «จำนวน … ส่วน ใน … ส่วน»: the number of parts the co-owner receives out of the total number of parts. For example, a half is 1 part of 2.

In which language is it filled in?

The form is in Thai only: names, addresses and the plot location are written in Thai script as on the ID card, house registration and chanote; the year is in the Buddhist Era.

Can the attorney be the new co-owner?

Yes, the form allows it. In that case the consent sentence printed in the remark is added, so the attorney acts both in their own name and as the other party's representative.

Are witnesses needed?

Yes, the form has lines for two witnesses who certify the grantor's signature or fingerprint. The signatures are handwritten.

What does registration cost and how long does it take?

The form does not say. Check fees, taxes and processing times with the land office where the plot is located.
