What this document is

หนังสือมอบอำนาจ (ท.ด. 21) is the standard power of attorney of the Thai Department of Lands (กรมที่ดิน). This version has the subject “แบ่งกรรมสิทธิ์รวม” printed on it — division of joint ownership: a plot held by several people under one title deed (โฉนด) is split into separate plots. With this power of attorney one of the co-owners (principal) authorises another person (agent) to act for them at the land office.

The authority text is fully printed on the form: request a survey for the division, bring the surveyor, place boundary markers and certify boundaries; if the survey gives a map or area different from before, consent to correct them to the actual figures; amend the application (if needed), register the division, pay and collect the remaining survey deposit, receive the title deed and make statements to the officer. Co-ownership is governed by the Thai Civil and Commercial Code (sections 1356–1366).

Who is involved

  • the principal — a co-owner of the plot on the title deed (ผู้มอบอำนาจ);
  • the agent — the person who goes to the land office (ผู้รับมอบอำนาจ);
  • two witnesses who attest the principal's signature or fingerprint.

If the agent is another co-owner or represents one, a note on the form requires adding consent for the agent to act both in their own name and on behalf of the other party. Usually all co-owners take part in the division; a co-owner who cannot attend gives their own power of attorney — check the procedure with the land office.

  • place and date (year in the Buddhist Era, พ.ศ.);
  • land details from the โฉนด title deed: map sheet, parcel number, survey page, deed number, sub-district, district and province;
  • name, Thai ID number, age, race, nationality, parents' names, address and phone of the principal and the agent;
  • additional powers — if needed, up to two lines;
  • signatures of the principal and two witnesses — by hand.

The co-owners' shares, the number of new plots and the names of the other co-owners are not written in this power of attorney.

What is usually attached

  • the original title deed (โฉนดที่ดิน);
  • copies of the principal's ID card and house registration, signed by them;
  • the agent's ID card or passport;
  • where needed — marital status documents or spouse's consent.
