What this document is
A standard employment contract (สัญญาจ้างแรงงาน / Employment Contract / ສັນຍາຈ້າງແຮງງານ) published by the Thai Department of Employment (Ministry of Labour) for hiring Lao nationals under the Memorandum of Understanding (MOU) between Thailand and Lao PDR.
The contract text is the same in Thai, English and Lao, and all three versions are equally authentic. It is made in duplicate — one copy for each party.
Who fills it in and where it is used
- the parties are an employer in Thailand (a company or an individual) and a worker who is a Lao national;
- the contract is part of the document set the employer (directly or through a licensed recruitment agency) prepares when hiring workers under the MOU;
- where and with which documents it is filed, how many copies are needed and whether certification is required — check with the provincial Department of Employment office or the Bangkok area office.
What the contract states
- date and place of the contract, employer name and address, employee name and address;
- position, wage rate (per month, day or hour) and pay day;
- contract duration (from the employee's arrival in Thailand) and worksite;
- working hours, days off, public holidays, annual leave, overtime and holiday pay;
- the other terms (food, accommodation, medical care, travel, obligations, termination) are printed in the form and need no input;
- signatures of both parties and two witnesses — by hand.
What to prepare
- employer details: name in Latin letters, address, name of the signatory;
- the employee's passport details and home address in Lao PDR;
- the agreed terms: position, wage, duration, working schedule.
The terms may not be less favourable than the Thai Labour Protection Act (for example the provincial minimum wage, at least 13 public holidays and 6 days of annual leave). Check the current requirements and the list of accompanying documents with the Department of Employment.
