What this document is

WP.33 (บต.33) is the Department of Employment (DOE) application for a work permit made on behalf of a foreigner who wishes to come to work in Thailand under the immigration law, pursuant to an agreement or Memorandum of Understanding (MOU) on labour cooperation between the Government of Thailand and the government of another country.

The form is in Thai with English captions and has 4 pages; page 4 is for official use only.

Who files it and where

  • the future employer in Thailand (a natural person or a juristic person) files it on behalf of the foreign worker — the employer signs as the applicant;
  • the form goes to the Department of Employment — check with DOE which office (Bangkok or provincial employment office) handles MOU applications for your workplace;
  • which nationalities, types of work and quotas are covered, as well as fees and processing times, are not stated on the form — check them with the office.

What the form asks for

  • employer: name, address, telephone and fax;
  • foreign worker: title, name, nationality, date of birth, age;
  • passport or document in lieu of passport: number, issuer, country, date of issue and expiry;
  • type and nature of work, place of work and the duration of the work permit applied for (years, months, days).

Documents to attach (section 4 of the form)

  • a copy of the worker's passport or document in lieu of passport;
  • the employment certification form from the future employer stating why a Thai national is not employed;
  • three 3×4 cm photographs of the worker;
  • if the employer is a natural person: a copy of the employer's identity document, passport or certificate of residence, and a business licence or certificate (if any);
  • if the employer is a juristic person: a copy of the business licence or registration certificate showing the type of business;
  • only for shop assistant work: commercial registration (or equivalent licence), income tax return, and contribution submission list or Thai employment certification.

After entering Thailand the worker also submits: a copy of the proof of permission to enter, a medical certificate (Section 64/1) and a copy of the employment contract. The office may ask for more documents — check before submitting.
