What this document is
WP.31 (แบบ บต.31) is the Thai Department of Employment (DOE) "Work Permit Application Form for application made on behalf of a foreigner pursuant to Section 41 Clause 4".
It is filed by a licensee — a company licensed to bring foreigners to work for employers in Thailand. The form is bilingual (Thai and English) and has 4 pages.
Who files it and where
- the licensee (recruitment agency) — itself through its authorized signatory, or through its employee holding a power of attorney;
- the form goes to the Department of Employment — in Bangkok the office for foreign workers, in other provinces the provincial employment office; check with DOE which office handles your case;
- the deadline, fee and processing time are not stated on the form — check them with the office.
What the form asks for
- licensee: name, authorized signatory, licence number, date of issue and validity; how the application is made and, with a power of attorney, the employee's details and the date of the power of attorney;
- foreigner: title, name, nationality, date of birth, age, passport or document in lieu of passport (number, issuer, country, dates);
- type and nature of work, the employer and its address, the place of work, the duration applied for (years, months, days).
Documents to attach (section 4 of the form)
- a copy of the foreigner's passport (or document in lieu of passport);
- the employment certification by the soon-to-be employer stating the reason for not employing a Thai national;
- three 3 x 4 cm photographs of the foreigner;
- a copy of the licence to bring foreigners to work and a copy of the contract with the employer;
- employer documents: for a natural person — an ID document (or passport, or certificate of residence) and, if any, the business licence; for a juristic person — the registration document showing the business category;
- if the foreigner will work as a shop assistant — commercial documents, the income tax return and proof of employing Thai workers;
- when filed through a power of attorney — a copy of the employee identification card and the power of attorney.
After entering Thailand, the foreigner also submits a copy of the proof of permission to enter, a medical certificate and a copy of the employment contract (items 4.8–4.10). The office may ask for other documents — check in advance.
