What this document is

หนังสือชี้แจงเหตุผลและความจำเป็นในการจ้างคนต่างด้าว is a one-page letter from a Thai company to the Immigration Bureau (Sub-Division 2, Immigration Division 1, Bangkok). The company names the foreigner it wants to employ, the position and the nature of the work, and states that it advertised the job to Thai workers but no Thai candidate applied.

It is usually attached to an application to extend stay or change to a Non-B (business/employment) visa. The form is in Thai only. Ask the immigration office in advance whether it is required in your case.

Who fills it in and signs

  • the employing company (บริษัท … จำกัด) fills it in;
  • it is signed by an authorised director, whose name is written in brackets under the signature;
  • the company seal is stamped next to the signature by hand after printing;
  • the letter goes to immigration together with the foreigner's application.

What the form asks for

  • date of the letter (day, Thai month name, Buddhist Era year);
  • company name and type of business;
  • the foreigner: title (นาย/นาง/นางสาว), name as in the passport, nationality;
  • the position and the nature of the work — why it needs this person;
  • the authorised director who signs.

Documents usually attached

  • the foreigner's application to immigration (for example TM.7 for an extension of stay);
  • the employer certificate STM.1 and company documents (company affidavit, financial statements);
  • the work permit and other documents the office requests.

No. The DOE letter is for hiring workers under MOU (domestic workers, labourers). This letter is addressed to immigration and concerns one foreign employee.

What should be written as the reason?

One or two sentences about the work and the knowledge, language or experience it requires that Thai candidates did not have. The form then states that no Thai applicant responded.

How much does it cost and how long does it take?

The letter itself has no fee. Fees and processing times depend on the immigration application it is attached to.
