What this document is

หนังสือมอบอำนาจ (ท.อ.๔) is the standard power of attorney form of Thailand’s Department of Lands (กรมที่ดิน) for land held not under a chanote but under a certificate of utilisation: น.ส.๓ (Nor Sor 3) or น.ส.๓ ก. (Nor Sor 3 Kor). With it the owner (principal) authorises another person (agent) to carry out a transaction with the plot at the Land Office: sell, mortgage, give, request a survey and so on.

The subject (“เรื่อง”) and the powers (“เป็นผู้มีอำนาจจัดการ”) are not pre-printed — they are written in. The back of the form lists seven warnings: state the land document details, describe clearly what is delegated, never sign a blank form, etc. The form is filled in in Thai.

Who makes it

  • the principal — the owner of the land under the น.ส.๓ / น.ส.๓ ก. (ผู้มอบอำนาจ);
  • the agent — the person who goes to the Land Office (ผู้รับมอบอำนาจ);
  • witnesses: according to the back of the form, at least one, and two if the principal uses a fingerprint.

According to the back of the form, a power of attorney made abroad should be certified by a Thai embassy or consulate or by a notary public.

What the form asks for

  • the subject, place and date (year in the Buddhist Era, พ.ศ.);
  • land document details: type (น.ส.๓ or น.ส.๓ ก.), number, book and page, for น.ส.๓ ก. also the aerial photo sheet and land number, sub-district, district and province;
  • name, Thai ID number, age, race, nationality, parents’ names, address and phone of the principal and of the agent;
  • exactly what the agent is authorised to do;
  • signatures of the principal and witnesses — by hand.

Documents usually attached

  • the original land document (น.ส.๓ or น.ส.๓ ก.);
  • copies of the principal’s ID card and house registration, signed by the principal;
  • the agent’s ID card or passport;
  • where relevant — marital status documents or the spouse’s consent.

The exact list, fees, taxes and processing time are not stated on the form — check with the Land Office (สำนักงานที่ดิน) where the land is registered.
