What this document is

“หนังสือมอบอำนาจ (สำหรับห้องชุด)”, form อ.ช. 21, is the standard power of attorney of Thailand’s Department of Lands (กรมที่ดิน) for transactions with a condominium unit (ห้องชุด). With it the principal authorises an agent to act on his or her behalf at the Land Office — for example to sell, buy or mortgage the unit, or to release a mortgage.

The form records the unit (unit number, floor, building, condominium name and registration number), the land the building stands on (title deed number, sub-district, district, province), the subject of the power of attorney, the principal and the agent, and the text of the powers. It is filled in in Thai.

Who makes it

  • the principal (ผู้มอบอำนาจ) — usually the unit owner named on the unit title (อ.ช. 2);
  • the agent (ผู้รับมอบอำนาจ) — the person who goes to the Land Office;
  • witnesses: according to the notes on the back, at least one, or two if the principal uses a fingerprint instead of a signature.

If the power of attorney is signed outside Thailand, the DOL notes recommend having it certified by a Thai embassy or consulate or by a notary public.

What the form asks for

  • place and date (year in the Buddhist Era, พ.ศ.);
  • unit and land details from the unit title (อ.ช. 2);
  • the subject (“เรื่อง”) and the powers: what exactly is entrusted and any special conditions;
  • name, Thai ID number (if any), age, race, nationality, parents’ names, address and phone of the principal and of the agent;
  • signatures of the principal and witnesses — by hand.

Documents usually attached

  • the original unit title (อ.ช. 2) — where the transaction requires it;
  • copies of the identity documents (ID card or passport) of the principal and the agent;
  • where relevant — marital status documents or the spouse’s consent.

The exact list of documents, fees, taxes and processing time are not stated on the form — check with the Land Office (สำนักงานที่ดิน) where the condominium is located.
