What this document is
WP.46 (บต.46, หนังสือรับรองการจ้าง) is the employment certification of the Department of Employment (DOE), Ministry of Labour of Thailand. In it the employer states who it is, its financial status and staff, the terms on which it wishes to employ a foreigner, and why the job is not given to a Thai national.
The form is bilingual (Thai and English) and has one page. It is signed by the employer or by a person authorised to sign for the business.
Who files it and where
- it is completed and signed by the employer — a Thai company, a foreign company (branch) or an individual employer; the signatory must be an authorised signatory of the business or its authorised representative;
- it is usually submitted together with the foreigner's work permit application to the Department of Employment (in Bangkok the office for foreign workers, in other provinces the provincial employment office);
- some other procedures also ask for a WP.46 — for example, the BOI LTR visa document list; check the requirements of your procedure;
- the form does not state a fee or deadline — check them with the office.
What the form asks for
- employer status: Thai juristic person (registration date, number, paid-up capital), foreign juristic person (registration date, money imported) or natural person (ID card and work permit numbers);
- name and address of the employer, type of business;
- income and income tax for the previous year (Buddhist year), current income, export value, number of tourists, Thai and foreign employees, classrooms and students where relevant;
- the foreigner: name, nationality, blood type, address in Thailand, type and nature of work, place of work;
- period of employment and contract end date, wage, other benefits, highest education, work experience, marital status;
- reasons for not employing a Thai national; name, title and date of the signatory.
Documents usually needed
- company registration certificate and list of shareholders, or the employer's ID card for an individual employer;
- financial statements or tax documents to support item 1.2;
- the employment contract with the foreigner.
