What the form is

Form บต.35 / WP.35 is the “Work Duration Extension Request Form for a Foreigner Performing the Works which can be Characterized as Necessary, Urgent or Ad-hoc pursuant to Section 61”. It is issued by the Department of Employment (กรมการจัดหางาน), Ministry of Labour of Thailand.

Section 61 of the Royal Ordinance on the Management of Foreign Workers’ Employment B.E. 2560 (2017) lets a foreigner perform necessary or urgent work without a regular work permit after notifying the registrar. If the work cannot be finished within the notified period, form BT. 35 is used to request an extension. The instruction sheet of the form states that the extension is not longer than 15 days.

The form is bilingual (Thai and English): particulars of the foreigner and passport, date of entry, number and date of the notification receipt (form WP.36), the original end date, the requested extension, the employer and the address of the place of work, and the list of attached documents.

Who files it and where

The foreigner performing the urgent work files it. If the foreigner and the employer cannot submit in person, the instruction sheet requires a power of attorney from both with a 10-baht duty stamp; the grantee must show the original ID card to the officer.

Documents to attach

  • form WP.35 with one 3×4 cm photograph;
  • a letter explaining why the urgent or ad-hoc work needs to be extended;
  • a copy of the notification receipt for urgent work (form WP.36);
  • a copy of the passport (photo page and entry visa page);
  • a power of attorney with a 10-baht stamp if the foreigner and the employer do not submit in person;
  • for a foreign employer: a copy of their work permit (if they do not work in Thailand — a power of attorney certified by a notary public and the Thai embassy); for a Thai employer: a copy of their ID card.
