What this document is

This is the standard power of attorney of Thailand's Department of Lands (กรมที่ดิน) — form T.D. 21 (ท.ด. 21) with the printed subject «ให้แบ่งเช่าที่ดินเฉพาะส่วน»: leasing out part of one's share of a plot. A co-owner of a plot with a title deed (chanote, โฉนดที่ดิน) uses it to have a representative register such a lease at the land office.

The form is one page and in Thai only. The text of the authority is already printed: the attorney leases out part of the grantor's share on the stated side of the plot, for the stated term and rent, with buildings if any, and gives statements to the land officer.

Who fills it in and where it is filed

  • the grantor — the co-owner who leases out part of their share;
  • the attorney — the person who goes to the land office on the grantor's behalf;
  • the power of attorney is presented at the land office (สำนักงานที่ดิน) where the plot is located when the lease is registered;
  • a lease of immovable property for more than 3 years is fully enforceable only if registered; the term may not exceed 30 years.

  • plot details from the chanote: map sheet (ระวาง), land number, survey page, deed number, sub-district, district, province;
  • place and date (year in the Buddhist Era, พ.ศ.);
  • grantor and attorney: name in Thai script, Thai ID number, age, race (เชื้อชาติ), nationality, parents' names, registered address, phone;
  • the side of the plot and the approximate area of the leased portion (rai-ngan-square wa);
  • buildings leased with the land, if any: type, storeys, number, house number;
  • lease term in years, start and end dates, total rent and rent per payment — in figures and in words, payment frequency and due day;
  • handwritten signatures of the grantor and two witnesses.

Documents usually needed

  • the original chanote of the plot;
  • copies of the grantor's and attorney's ID cards and house registrations, signed as true copies;
  • the lease agreement and, if required, a plan of the leased portion.

The form does not state the full list of documents, fees or processing times — check them with the land office. The form refers to a warning on the back; the official file has no reverse page.

What is this power of attorney for?

How is it different from the power of attorney to lease out the whole plot?

This form has the printed subject «ให้แบ่งเช่าที่ดินเฉพาะส่วน» — only part of one co-owner's share is leased. The Department of Lands has a separate form with the subject «ให้เช่า» for leasing the whole plot.
