What this document is

The T.D. 21 (หนังสือมอบอำนาจ) is the standard power of attorney of the Thai Department of Lands (กรมที่ดิน). This version has the subject “จดทะเบียนห้ามโอน” printed on it — registration of a prohibition of transfer on a land plot. Such a prohibition is usually imposed with a gift or by will: the recipient may not sell or otherwise transfer the land for the stated period, and if the prohibition is breached the land passes to a named third person.

With this power of attorney the land owner (principal) authorises another person (agent) to register the prohibition at the land office: file the application, make statements to the officer and sign documents until the registration is complete. The form is completed in Thai.

Who is involved

  • the principal — the owner who transfers the land (ผู้มอบอำนาจ);
  • the agent — the person who goes to the land office (ผู้รับมอบอำนาจ);
  • the transferee (ผู้รับโอน) who receives the land subject to the prohibition;
  • the person who receives the land outright if the prohibition is breached;
  • two witnesses who certify the principal’s signature or fingerprint.

If the agent is the transferee or represents them, the note on the form requires adding consent for the agent to act both in their own name and on behalf of the other party.

  • place and date (Buddhist Era year, พ.ศ.);
  • land details from the title deed (โฉนด): map sheet, land number, survey page, deed number, sub-district, district, province;
  • name, Thai ID number, age, race, nationality, parents’ names, address and phone of the principal and the agent;
  • title and name of the transferee;
  • the prohibition term in years;
  • the instrument containing the prohibition (gift contract or other) and its date;
  • title and name of the person who receives the land if the prohibition is breached;
  • signatures of the principal and two witnesses — by hand.

What is usually attached

  • the original title deed (โฉนดที่ดิน);
  • copies of the principal’s ID card and house registration, signed by the principal;
  • the agent’s ID card or passport;
  • the gift contract or other instrument with the prohibition and the transferee’s documents — as the office requires.

The exact list, fees and processing times are not stated on the form — check with the land office (สำนักงานที่ดิน) where the land is registered. Under the Thai Civil and Commercial Code (s. 1700) a prohibition of transfer may not exceed 30 years.
